These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with www.weefeen.com website (the "Service") operated by Weefeen S.A.S ("us", "we", or "our").

Please read these Terms and Conditions very carefully before using the Service. They cover important information regarding user accounts, reviews, audio or video uploads, copyrights, and the overall use of the platform.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Accounts​

When you create an account with us, you agree to provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

  • Single Account: Users are permitted only one account. If you wish to be both a performer and a reviewer, you must manage both roles under the same account.
  • Personal Information: You must use your real name and a genuine profile photo. Using images of other individuals, including public figures, is prohibited.
  • Unique Email: Each user must register with a unique email address. Multiple accounts for the same individual are not allowed.
  • Profile Completion: To request reviews from top reviewers, your profile must be complete, including a biography and other necessary fields.

You are responsible for safeguarding your password and any activities under your account. Notify us immediately if you suspect unauthorized access to your account.

2. Use of the Platform​

  • Free to Use: The platform is free for general use, including creating a profile, uploading performances, and accessing basic features.
  • Proxy Account Use: You may use an account on behalf of a third party, such as a child or a student, provided you have explicit rights and permissions to manage that party's content and activities on the platform.
  • User Profile as a Public Page: Your Weefeen profile functions as a public page, allowing you to showcase your performances, biography, and other relevant information. This page is accessible to the public, so ensure that the information shared is accurate and appropriate.
  • Compliance: All users must adhere to platform guidelines, ensuring that the service is not misused. This includes respecting the rights of others and not violating any legal or ethical standards while using the platform.

3. Video and Audio Uploads​

  • Authenticity of Content: Only upload videos corresponding to musical performances and to the specific composition to which you are attaching the performance during upload. Uploading unrelated content is prohibited.
  • Copyright Compliance: Ensure all uploaded content adheres to copyright laws, and that you have the rights to share any audio or video content on Weefeen.
  • Special Attention: You have the capability to publish a performance, making it accessible for others to view freely. Make sure you have the necessary rights to publish the content before doing so.

4. YouTube Embedded Performances​

  • Respect for YouTube Terms: Users embedding YouTube videos must comply with YouTube’s terms and conditions. All copyrights for embedded content must be respected.

Special Attention:​

  • You can ask for a review based on the YouTube embed option only if you are the one performing in the video. Requesting a review for videos featuring other performers is not allowed.
  • Ensure that you own the YouTube channel corresponding to the video if you are requesting a review. If a third party owns the video, they may remove it from YouTube, which could cause the Weefeen performance based on this embedded video to result in a broken link.
  • This could be especially problematic if a paid review is involved. If no paid review has been requested, there is little harm in removing the Weefeen link. However, if a review has been completed, the broken link could negatively impact your experience.
  • While you may embed any YouTube videos that allow embedding, you should not publish them on the Weefeen platform unless you hold the necessary copyrights.

5. Scores and Sheet Music​

  • Public Domain Scores: Weefeen provides access to public domain scores. Users can request additional scores, and Weefeen may add them based on availability.
  • Private Scores: For private reviews, the use of scores is restricted to the interaction between the performer and reviewer. Reviewers cannot reuse private scores for other purposes.

6. Reviews​

  • General Reviews: Provide a high-level overview of performance, highlighting key areas for improvement with a concise summary. There is no minimum word count for General Reviews; we prioritize quality and relevancy of the insights over the length (quality over quantity).
  • Detailed Reviews: Offer in-depth, measure-by-measure feedback with audio-linked notes, allowing performers to pinpoint where improvements are needed. There is no minimum or maximum number of comments required for Detailed Reviews; the focus is on providing valuable and relevant insights rather than quantity.

7. Payments and Pricing​

  • Free Platform Features: Basic access to the platform, such as creating a profile and uploading performances, is free.
  • Review Fees: Fees apply for reviews. General reviews are priced by the platform, while detailed reviews are quoted by the reviewer.
  • Platform Fee: Weefeen charges a 10% platform fee on all paid transactions.
  • Refunds: Refunds are handled case-by-case. Payments are held in escrow and only released once the review is completed, allowing time for any disputes.

8. Prohibition of Off-Platform Transactions​

Performers and reviewers agree not to engage in any financial transactions related to online or remote reviews outside of Weefeen. All payments must be processed through Weefeen's secure payment system.

9. Contact Information Disclosure and Restrictions​

Performers are prohibited from contacting reviewers outside of Weefeen regarding online or remote reviews or any services related to the platform. This includes attempts to connect via social media or phone. Communication regarding online or remote reviews must remain within Weefeen's platform.

10. Post-Review Engagement (Masterclasses or Events)​

Performers may participate in masterclasses or events with reviewers after receiving an online or remote review. Weefeen encourages such connections, but all payments for online or remote reviews must still be processed through Weefeen.

11. Non-Circumvention Agreement​

Performers and reviewers agree to a non-circumvention period of 3 years after their initial contact on the platform. During this time, they may not establish independent agreements outside of Weefeen for services related to online or remote reviews.

Weefeen respects the intellectual property rights of others. If you believe content on Weefeen infringes your copyright, notify us by sending a detailed message to copyright@weefeen.com.

13. Limitation of Liability​

Weefeen S.A.S. and its affiliates, directors, employees, and partners will not be liable for indirect, incidental, or consequential damages arising out of your use of the Service, including any loss of profits or data.

14. Termination​

Weefeen may terminate or suspend your account immediately, without prior notice, for any violation of these Terms.

15. Governing Law​

These Terms are governed by the laws of France. Any disputes will be resolved under the jurisdiction of the courts in France.

16. Changes​

We reserve the right to modify these Terms at any time. Changes will be effective upon posting, and we will provide 30 days’ notice for any material changes. Continued use of the Service constitutes your acceptance of the updated Terms.
